This article is part of the series “Buying property in Spain with confidence,” a LiveInSpain guide for American and Latin American buyers who want to purchase property in Spain with security, local insight, and professional support.

Negotiation, offer, and earnest money contract

When the buyer finds a property that truly fits, a decisive phase begins: the negotiation.

In Spain, the process can be different from the United States or many Latin American countries. That is why it is important to understand the steps, act strategically, and avoid rushing.

At LiveInSpain, we support the buyer so they can present a solid, reasonable, and well-structured offer.

Analyze before making an offer

·         Market price.

·         Time the property has been listed.

·         State of conservation.

·         Demand in the area.

·         Possible renovation needs.

·         Seller’s situation.

·         Reasonable negotiation margin.

·         Costs associated with the purchase.

·         Available documentation.

An offer should not be based only on what the buyer wants to pay. It must make market sense.

Negotiating with strategy

Negotiating does not simply mean asking for a discount.

Sometimes the negotiation may focus on price, but also on timing, furniture, conditions, repairs, payment method, or signing deadlines.

Every transaction has its own context.

Our role is to help the buyer present a serious, well-argued, and viable proposal.

The importance of not acting on impulse

When a buyer really likes a property, it is normal to want to move quickly. But in an international purchase, prudence is essential.

Before committing money, it is important to carefully review the documentation and the conditions of the transaction.

Buying in a hurry can be costly.

The earnest money contract

In Spain, once an agreement has been reached, it is common to sign an earnest money contract, known as a contrato de arras.

This document sets out the main terms of the purchase: price, amount paid, deadline for signing the deed, identification of the parties, the property’s situation, and the consequences if either party fails to comply.

It is a very important step and must be reviewed carefully.

That is why we recommend that the buyer always has specialized legal advice.

Coordination with lawyers and professionals

From LiveInSpain, we can coordinate this phase with lawyers, administrative agencies, banks, notaries, and other professionals involved.

Our objective is for the buyer to understand every document, every deadline, and every commitment before signing.

Trust is not based on moving quickly. It is based on moving correctly.

A well-structured offer protects the buyer

When negotiation is handled with criteria, the buyer gains security.

Risks are reduced, misunderstandings are avoided, and the transaction becomes stronger.

At Liveinspain, we support this process so the international buyer does not feel alone during such an important phase.
